尹锡悦被控“一般利敌罪”，特检组称其“泄露韩军作战等军事机密”

[环球时报驻韩国特约记者 刘媛 环球时报特约记者 杨凡]据韩联社报道，韩国负责调查内乱案的特检组10日以涉嫌一般利敌罪、滥权妨害他人行使权利罪，对前总统尹锡悦、前国防部长官金龙显、前国防部反间谍司令部司令官吕寅兄提起公诉。 韩国前总统尹锡悦 资料图 图源：视觉中国 报道称，特检组经查决定，上述人员不适用“诱致外患罪”，而适用一般利敌罪。根据《刑法》规定，一般利敌罪不以通敌为构成条件，凡是对国家军事利益造成损害，或为敌国带来军事利益即可适用。去年10月，尹锡悦等人涉嫌指使无人机作战司令部向平壤渗透无人机，以为实施紧急戒严找名分为目的故意刺激朝方。特检组认为，无人机在平壤附近地区坠落，导致韩军作战和战力等军事机密被泄，故尹锡悦等人的一般利敌罪名成立。
此前一天，韩国法务部发布的资料显示，尹锡悦在看守所被羁押期间接收的代管金金额巨大，引发外界对该制度遭滥用、沦为政治资金筹措渠道的质疑。据韩国媒体报道，看守所代管金用于在押人员购买洗漱用品等生活必需品，任何人均可汇款。根据相关规定，代管金存入笔数和总额没有限制，在看守所内使用金额上限为400万韩元（约合2万元人民币），超出部分可在被羁押期间或获释后提取。
据报道，韩国法务部向祖国革新党国会议员朴恩贞提交的资料显示，尹锡悦7月10日再次被捕至10月26日，累计接收超过6.5亿韩元代管金（约合318万元人民币），其妻子金建希接收约2250万韩元（约合11万元人民币）代管金。朴恩贞说，看守所代管金制度设立的初衷是为方便在押人员生活，如今却沦为政治资金筹措渠道，应尽快完善相关制度，严控限额。：陈建瑞 SN243
